This conditional sale contract is made between:
Nanette Pearl
(Herein after known as seller)
And
_________________________________________
(Herein after known as buyer)
The seller agrees to sell the buyer the dog of the following description:

Under the following terms and conditions:
Initial sale price ________________ -non-breeding.
1. THE SELLER GUARANTEES
a) The dog to be healthy at time of sale. Guarantee for 48hrs. If within this time the dog is found to be in ill health, it may be returned (at expense of buyer) for a full refund provided the dog has been checked by a DVM (proof to be provided to seller). Seller is not responsible for injury, illness or death of dog that is caused after leaving the home of the seller. The seller will not cover any medical costs.
b) The seller will not be responsible for any dog sold that demonstrates extreme shyness or aggressiveness as this can be attributed to environment (i.e.: improper handling, lack of socialization, lack of obedience, abuse, etc.). In case of older dog (4 months or older) temperament is demonstrated at time of purchase and found to be acceptable by buyer.
c) Any pet dog purchased is guaranteed until 1 year of age against any hereditary defects. If such occurs, with presentation of a DVM report, the dog will be replaced with the following conditions:
i. Buyer may return (at buyers’ expense) dog and signed registration papers to the home of the seller. Seller will, for the sum of $100.00, replace dog with one of original quality when such a dog is available (pick up and or shipping will be at buyers’ expense)
ii. The buyer may keep the original dog with proof of sterilization. Seller will not be responsible for any vet bills in regards to health of the dog. Seller will replace dog with one of original quality when such a dog is available (pick up and or shipping will be at buyers’ expense)
d) Buyer understands a dog sold as pet quality it is not guaranteed against disqualifying faults (i.e.: improper bite, lack of testes, poor color etc.)
e) Seller is not responsible for death, injury or deformity of dog due to accident, illness or deviation from proper care. Health care of dog is full responsibility of buyer.
2.
THE BUYER AGREES:
a) To notify seller of any change of address or telephone number.
b) To send proof of sterilization of the pet dog to seller. All pet dogs must be sterilized between the ages of 4 to 9 months. Older dogs (over 6 months of age), this must take place within 30 days of purchase.
c) To attend an obedience class by a qualified instructor.
d)
To accept full responsibility for proper care of dog once it leaves
seller.
i. Coat, nails, yearly examinations, all needles required, and to seek medical attention whenever required.
ii. Keeping dog contained in suitable manner: NOT CHAINED OR ALLOWED TO RUN AT LARGE.
e) Dog cannot be given away or sold. Seller has first option to have dog returned to the home of the seller with no money owing and registration papers signed over to the seller, therefore maintaining seller’s interest in dog.
f) Buyer understands and agrees this is a legal and binding contract. Failure to abide with any condition on this contract will constitute a waiving of his/her rights to ownership of said dog and will entitle seller to assume and return legal ownership and possession of the dog without further notice or renumeration to the buyer. Signed registrations papers to accompany dog.
VIOLATIONS OF THIS CONTRACT SHALL ENTITLE VEGRENAN KENNELS TO $2500.00 CASH IN DAMAGES WITHIN 10 DAYS.
BUYER UNDERSTANDS THAT IN NO WAY UNDER ANY
CIRCUMSTANCES CAN NEITHER NANETTE PEARL NOR VEGRENEN KENNELS REG’D BE HELD
LIABLE, RESPONSIBLE OR ACCOUNTABLE FOR ANY FUTURE ACTIONS OF THIS DOG. EFFECTIVE IMMEDIATELY UPON
The undersigned have read and understand this contract and agree to its terms and provisions. Given in duplicate – seller keeping original copy.
